SUB: REVISED GUIDELINES FOR SANCTION OF SABBATICAL LEAVE


The Bank had introduced “Special Leave Scheme” for sanctioning Leave on Loss of Pay to Employees / Officers for specific purposes and the same had been communicated Vide Circular No. 20/2000, dated 14/02/2000, with subsequent modifications from time to time.
The Government of India, New Delhi has recently issued guidelines to introduce Sabbatical Leave of 2 years to women employees of Public Sector Banks to meet their special problem during their career.
It has therefore been decided to suitably modify our existing Sabbatical Leave scheme to incorporate the guidelines issued by the Government of India and permission has been granted by our Board of Directors to introduce the revised Sabbatical Leave Scheme in our Bank w.e.f. 01/04/2012.
The salient features of the revised scheme are mentioned as below :
I) PURPOSE:

  1. For prosecuting higher studies both inland as well as abroad.
  2. Health grounds of self / dependent family members.
  3. Joining the spouse
  4. Taking care of the family or children.

II) ELIGIBILITY :
All the employees who have put in a minimum of 5 years of active service and confirmed in the services of the Bank are only eligible to apply under this Scheme.
However, Sabbatical Leave before completion of 5 years of active service can be sanctioned only in exceptional circumstances relating to health grounds of Self / dependent family members.
Sanctioning of the leave shall be at the discretion of the Bank, depending upon the grounds for which the leave is sought for and merits of individual cases. It cannot be claimed as a matter of right. : 2 :
III) PERIOD OF LEAVE :
The minimum period for which leave to be availed under this scheme shall be 1 year at a time continuously and can be extended upto 2 years. In entire service the maximum period of leave permissible under the scheme is only 2 Years (24 Months).
The number of occasions leave can be availed shall be restricted to 2 times in the entire service of the employee.
However, Women employees can avail Sabbatical Leave for a period of atleast 3 months at a time and the leave shall not be taken more than once in a year. In such cases, the women employees will not be permitted to rejoin duties before the expiry of minimum 3 months of Sabbatical Leave. The Women employee can avail Sabbatical Leave on single occasion of 2 years also.
Before expiry of the sanctioned leave, employees cannot rejoin for duty without prior permission from the Competent Authority.
IV) OTHER CONDITIONS :

  1. The Sabbatical Leave can be availed even when the leave of other eligible category is in credit.
  2. It can be sanctioned in continuation of any other category of leave standing to the credit of the employee.
  3. It can be availed as extension of Maternity Leave in which the minimum eligible service of 5 years in the Bank shall not be mandatory.
  4. Leave shall not be granted for avoiding transfer / change of placement etc.
  5. Both husband and wife, if employed in the Bank, can avail the leave, provided the reasons attributed for availing the leave are convincing and acceptable to the Bank.
  6. The Sabbatical Leave shall be without Pay, Allowances and any consequential monetary and nonmonetary benefits. No increments will be earned during the Sabbatical Leave and the employee will rejoin at the same stage of pay as was existing at the time of availing the Sabbatical Leave. The Sabbatical Leave period shall not be counted as service for the purpose of calculation of terminal benefits such as Gratuity / Provident Fund / Pension etc. In other words, the period spent on Sabbatical Leave shall not be treated for any purpose whatsoever.

: 3 :

  1. The employees against whom Disciplinary Action / Court Cases/ Criminal Cases/ CBI Cases are pending / contemplated will not be entitled to avail the leave under this scheme, till final outcome of the pending matter concerned.
    1. 8. a. Specialist Officers (other than Women Employees) are not eligible to seek Sabbatical Leave except on health grounds for self and dependent family members.
    2. b. Officers (other than Women Officers) who have executed the Bond for posting to Specialised setup / Abroad / On the Job Training / Subsidiaries / DIT / IS Audit etc. are not eligible for Sabbatical Leave
  2. The employees are not eligible for facilities such as Leave Fare Concession, Leave, Bonus, Exgratia, Medical, Festival Advance, Hospitilisation Expenses, Expenses under Staff Welfare Measures etc. during the leave period. The LFC Block falling due during the leave on loss of pay period shall be frozen temporarily and extended to the extent of the leave availed on rejoining duties.

10.The employees on Sabbatical Leave shall not be eligible to participate in any promotion exercises during the Sabbatical Leave period, even if otherwise eligible. The employees, before proceeding on leave, shall give an Undertaking in writing to the Bank, foregoing the claim for being considered for posts carrying Special Allowance and Promotions in whatever cadre during the leave period.
11.The Officer employees shall not eligible for retention of Banks’ quarters / furniture items during the leave period and have to make their own arrangements for stay etc.
12.The Officer employees shall submit the return of Immovable / Movable / Valuable property as at 31st March every year before the stipulated last date i.e. 30th June every year and also report transactions exceeding ` 25,000/as required under provisions of Conduct Regulations.
13.During the period of leave, the workmen employees shall be governed by the provisions of Bipartite Settlement / Service code and in respect of Officer employees, Provisions of Conduct Regulations / Service Regulations.
14.The employees availing the leave shall intimate to the Bank, the LOCAL ADDRESS for correspondence and also undertake to inform the Bank i.e. the HRM Sections concerned, the change of Local Address for communication, if any, from time to time. Any Communications / Notices sent to the last intimated Local Address shall be deemed to be proper notice for all purposes. : 4 :
15.The employee, if so desire to leave the services of the Bank by submitting Resignation / Voluntary Retirement, during the leave period, may do so by submitting the applications in the appropriate format as given in our Circular 343/93 dated 18.11.1993, through HRM Sections concerned and shall be considered as per the scheme in vogue.
V. LOANS / ADVANCES OUTSTANDING IN THE NAME OF THE EMPLOYEE AND WHO INTEND TO AVAIL LEAVE ON LOSS OF PAY UNDER THIS SCHEME :
All unsecured liabilities are to be cleared before proceeding on leave.
In case of secured loans, with the specific permission of the respective Sanctioning Authority, the liabilities could be continued provided they make arrangements for payment of monthly installments towards the loan component and interest payments as and when due.
The employee shall submit a letter of undertaking authorizing SPF / Gratuity Fund/ Pension Fund for adjustment of the proceeds towards outstanding loans and liabilities without insisting for a notice / intimation from the Bank.
Employees have to make their own arrangements in respect of payment of Insurance Premia or any other payments of the kind that may fall due during the leave period.
Fresh Loan / enhancement in limits during the leave period will be considered provided employees undertake to remit the monthly installments / interests as and when due.
VI. LIEN ON EMPLOYMENT :
The employees shall have lien on the employment with the Bank during the leave period.
VII. RECALLING FOR DUTIES DURING THE LEAVE PERIOD / REJOINING DUTIES AFTER EXPIRY OF LEAVE PERIOD :
During the leave period, the Bank has a right to recall the employees in case of exigencies. Failure to report in such instances shall be construed as a MisConduct.
Three Months before the completion of the Leave Period, employees who intend to extend the leave by further period, have to take up with appropriate authorities through concerned Circle Office. : 5 :
After expiry of the leave sanctioned, the employees shall report back for duties to the Branch / Office indicated by the respective HRM Sections.
In case, the employee does not report for duties on the expiry of the leave period or on the date on which the Bank has advised him / her to report for duties upon recall, it shall be deemed that he / she has resigned from the services of the Bank in terms of the irrevocable letter of resignation to be given by him / her at the time of seeking Sabbatical Leave.
VII. TAKING UP EMPLOYMENT DURING THE PERIOD ON LEAVE :
No Employee shall be entitled to take up any Employment / Vocation / Business/ Profession or engage directly or indirectly in any Trade / Business etc. during the leave period. If any such instances come to the knowledge of the Bank, the Bank may cancel the Sabbatical Leave and recall the employee and proceed in the matter as deemed fit.
IX. COMPETENT AUTHORITY / SANCTIONING AUTHORITY :
The sanctioning authority for considering grant of Sabbatical Leave shall be the General Manager, Human Resources Wing in respect of both Workmen & Officer Employees.
X. GENERAL :

  1. Employees / Officers who intend to avail leave on loss of pay under this scheme shall submit an application with other undertakings as per Annexure to this Circular, to the General Manager, Human Resources Wing with proof for the purpose for which the leave is sought for and shall give 3 months notice for availment of such leave. All applications have to be routed through the HRM Sections concerned.
  2. The HRM Sections concerned, on receipt of the application, shall verify the details furnished by the employee and forward the same to General Manager, Personnel Management Section, Human Resources Wing, Head Office, as per the format along with their recommendations after due scrutiny of the applications. If the employee has requested for permission to continue the secured liability/ies, necessary permission letter obtained from the competent authority is to be enclosed alongwith Application / Undertaking.
  3. The decision of the Competent Authority to accept / reject the applications for Sabbatical Leave is final.

THIE REVISED POLICY SHALL COME INTO EFFECT FROM 1ST APRIL, 2012 AND SHALL BE IN SUPERSESSION OF THE EARLIER SCHEME.

If I fail to report for duties on expiry of the leave period or on the date on which the Bank has advised me to report for duties upon recall, it shall be deemed that I have resigned from the Services of the Bank w.e.f. the said date on which I was required to report for duties in which case the requirement of 3 months notice shall not be applicable and in such cases, the Bank is authorised to adjust the terminal benefits payable to me if any, to the Liabilities outstanding / recoveries to be made and I undertake to receive the balance of terminal benefits, if any from the Bank. If the terminal benefits payable to me is not sufficient to close the liabilities, I will make my own arrangements to clear the liabilities immediately.
  3. This undertaking is irrevocable and I shall bound to the terms & conditions laid therein for grant of Sabbatical Leave.
