MEMORANDUM OF SETTLEMENT DATED 22.03.2006 ENTERED INTO BETWEEN THE MANAGEMENT OF CANARA BANK AND CANARA BANK EMPLOYEES' UNION UNDER SECTION 2(p) OF THE INDUSTRIAL DISPUTE ACT, 1947 READ WITH SECTION 18 (1) OF INDUSTRIAL DISPUTES ACT, 1947 AND RULE 58 OF INDUSTRIAL DISPUTES (CENTRAL) RULES 1957 IN THE MATTER OF PROMOTION OF CLERICAL CADRE TO JUNIOR MANAGEMENT GRADE SCALE-I.

SHORT RECITAL OF THE CASE:
WHEREAS the Canara Bank and the Canara Bank Employees' Union entered into various Settlements under the provisions of Industrial Disputes Act, 1947 and Rules of Industrial Disputes (Central) Rules, 1957 in the matter of promotion, whereas the settlement dated 11.10.2000 in the matter stand lapsed in 2002.
WHEREAS the parties to the said Settlements felt that there is need to enter a fresh Settlement in the above matter. The matter was duly discussed in the earlier Joint Conferences and further discussed during the Joint Conference held on 20.03.2006, 21.03.2006 & 22.03.2006 and the following Settlement is arrived at in supersession of all earlier Settlements in this regard.
TERMS OF SETTLEMENT
PROMOTION TO JUNIOR MANAGEMENT GRADE SCALE-I:
SCHEME : It is mutually agreed that there shall be 2 tier policy for promotion to Junior Management Grade Scale-I, viz.
a) Merit Tier - 50% of the vacancies b) Merit cum Seniority Tier - 50% of the vacancies
For promotion under Merit Tier, weightage shall be given for qualification marks, marks in written test, marks for service record and interview marks. For promotion under Merit cum Seniority Tier, weightage shall be given for service, written test marks, qualification marks, marks for service records and interview marks. This is however, subject to the employees passing the written test with qualifying marks.
VACANCIES AND RESERVATIONS :
It is mutually agreed that vacancies arising from time to time in Junior Management Grade Scale I shall be filled in by promotions from ranks and through direct recruitment at 80% and 20% respectively. It is agreed that any vacancy arising out of death, resignation etc., of the officers taken as direct recruits shall also be available for the Bank for being filled in through direct recruitment over and above the allocation made for such recruitment. It is also agreed that besides the vacancies set apart as above, the Bank may also fill in through direct recruitment the post of Specialist Officers like Chartered Accountants, Financial Analysts, Lawyers, Statisticians, Computer Programmers, System Analysts, Technical Field Officers, Agricultural Extension Officers, Doctors etc.
Out of the vacancies declared for filling up through promotion from Clerical Cadre, reservation/relaxation to employees belonging to SC/ST/Persons with disability category shall be provided as per Government guidelines.
A] PROMOTION :
It is mutually agreed that promotions to Junior Management Grade Scale-I shall be on the following basis :
1) ELIGIBILITY AND QUALIFICATION :
The following conditions shall be applicable for Merit cum Seniority Tier and Merit Tier :
a] Eligibility : All employees in the Clerical cadre who satisfy the following stipulation in respect of Qualification, Qualifying Service, Written Test and Interview are eligible for consideration for promotion.
b] Qualification : A minimum qualification of pass in SSLC or equivalent examination inclusive of those persons who are eligible for public services. In the case of those employees who do not satisfy the stipulation for minimum qualification, they shall however be eligible if they have passed Part-I of the CAIIB/AIB (London) or JAIIB examination.
2) QUALIFYING SERVICE :
Employees in the Clerical Cadre who satisfy the following stipulation for qualifying service shall be eligible for consideration for promotion.
i) Employees who have put in a minimum of 5 actual years of service in the Bank
(OR)
ii) Employees with 4 actual years of service in the Bank and who have passed Part-I of the CAIIB / AIB (London) or JAIIB examination
(OR)
iii) Employees with 3 actual years of service in the Bank and who have passed both parts of CAIIB / AIB (London) examination.
In respect of SC/ST employees, 2 years relaxation in qualifying service (i), (ii) & (iii) above is available.
The following conditions shall be equally applicable for both Merit cum Seniority Tier and Merit Tier:
i) In the case of employees who have been promoted from the rank of Sub-staff, their services shall count only from the date of their promotion as Clerks;
ii) In the case of Ex-Servicemen employees who have been recruited against reserved vacancies, weightage for the past service rendered by them in the armed forces be extended in the ratio of 5 : 1, subject to a maximum of 2 years after they have rendered at least 3 years of actual service in the Bank after re-employment.
This benefit shall be available to the Ex-Servicemen employees only once during the service after they fulfill the minimum eligibility in terms of the respective settlements.
The weightage as above will be available to Ex-Servicemen re-employed in the clerical cadre either for posting as Special Assistant within the clerical cadre or for promotion to Junior Management Grade Scale I. Such employees are required to exercise option for the purpose at the time of first available opportunity and the option once exercised will be final and no change would be allowed later whether or not they are successful in that exercise.
iii) To the service so determined, their service in Canara Bank shall be added, whereafter for the purpose of determining the completed years of service fraction of 1/2 year or more shall be treated as one year and less than 1/2 year shall be ignored.
3) MODE OF SELECTION :
Eligible employees satisfying the Qualification and Qualifying Service shall be administered a Written Test and the successful candidates shall undergo the Interview Process.
4) PROCEDURE :
i) WRITTEN TEST : The Head Office of the Bank shall issue a Memo indicating the eligibility criteria and the date for conducting the Written Test. The eligible employees shall communicate their willingness to take up the Written Test to Staff Section (W)/HRM Section of the Circle /Staff Administration Section of Inspection Wing / International Division / Head Office through their Branch / Office. If any eligible employee does not convey the willingness within such a date, it shall be presumed that such employee is not interested in taking up the Test. All employees who satisfy the stipulation under Qualification and Qualifying Service and who have communicated their willingness to take up the Written Test within the prescribed date shall appear for the Written Test on the following subjects :
1] Banking Law and Practice 2] Manual of Instructions/Circulars/Memos/Other Communications issued by the Bank 3] Latest Scenario and development in the Banking Industry 4] General English
The test will be objective or descriptive type or both conducted by the Bank/outside agency.
i) Out of the 100 Marks for Written Test, an employee shall secure a minimum of 40 Marks for a Pass for general candidates and 35 marks for SC/ST candidates.
ii) Employees who have come out successful in the Written Test but not promoted have to undergo the process of Test along with others in the subsequent applications as per the policy in force at the relevant time.
ii) RANKING :
a) Merit Tier : Employees who have come out successful in the written test will be ranked under this tier taking into account the following parameters :

The ranking list will be first drawn under Merit Tier followed by Merit-cum-Seniority Tier.
5) MARKS FOR SERVICE, QUALIFICATION, WEIGHTAGE FOR WRITTEN TEST, MARKS FOR SERVICE RECORD AND MARKS FOR INTERVIEW WHEREVER APPLICABLE SHALL BE AWARDED AS UNDER:
A) QUALIFICATION :
B). WEIGHTAGE FOR MARKS SECURED IN WRITTEN TEST :
a)Merit Tier : 50% of the marks secured in the written test will be taken as weightage for promotion.
b)Merit cum Seniority Tier : 35% of the marks secured in the written test will be taken as weightage for promotion.
C)MARKS FOR SERVICE RECORD :
The service record of the employee for 3 calendar years preceding the relevant date of application shall be taken into account under the following 2 traits :
MAX. MARKS
(i) SERVICE RECORD FOR PRECEDING 3 YEARS : (MAX. 12 MARKS)
Marks under Service Record shall be awarded as follows :
1. Maximum of 12 marks will be given to employees having clean service record.
2. Out of the above, for the following instances, marks will be deducted :
a) One Mark for Dishonour of Cheque on each occasion. However if the employee is charge-sheeted for this, marks are deducted under chargesheets as mentioned in Para (c) below.
b) Two Marks for cautioning letter issued by Staff Section for wilful disobedience, insubordination or for any other lapse.
c) If any employee is chargesheeted and found guilty, Four Marks for minor misconduct and Six Marks for Gross misconduct are deducted in respect of each chargesheet.
(ii) CONFIDENTIAL REPORT : (MAX. 6 MARKS)
Confidential reports for the past 3 calendar years (6 half yearly reports) preceding the relevant date are taken into account and marks are awarded as under a) Superior - Each report - 1.00 b) Above Average - Each report - 0.75 c) Average - Each report - 0.50 d) Poor - Each report - 0.25
D) INTERVIEW :
i) Employees who have come out successful in the Written Test shall be interviewed by a Three Member Committee, two of whom shall be Executives and third one belonging to SC/ST may also be an executive or in the alternative, not below the rank of Scale II. Marks for interview will be awarded independently by each member and average of marks awarded by the members will be taken to be the marks obtained by an employee for interview.
ii) Marks for interview shall be awarded under the following heads, subject to a maximum under each sub-head.
E) SERVICE MARKS : (Applicable under Merit-cum-Seniority Tier) .
1 Mark for each completed year of service as on the relevant date subject to a maximum of 15 marks. More than six months shall be counted as one year and less than six months shall be ignored.
PROMOTION OF SPORTS PERSONS IN CLERICAL CADRE TO JUNIOR MANAGEMENT GRADE SCALE I:
I. ELIGIBILITY CONDITIONS :
Minimum Qualification : Pass in SSLC or equivalent examination.
II. QUALIFYING SERVICE AND PERFORMANCE IN SPORTS / GAMES / INDIVIDUAL EVENTS :
CATEGORY A : (Participation at recognised international level and securing a position among first three winners of the event) :
i) Minimum one year service in the Bank.
ii) Should have represented India at the recognised international level in any of the games specified (which are furnished hereunder after category 'B') and have actually played / participated for the country (not merely being in the reserves or standby) and secured a position among the first three winners of the event. However, such recognition should have been achieved not earlier than one year from the date of consideration for promotion.
OR
Should have won Arjuna Award or any other National Award/s for excellence in Sports.
"Recognised International level" means the game recognised as an international game by the Banks' Sports Board.
"Securing a position among first three winners of the event" refers to individual games identified by the Banks' Sports Board only.
CATEGORY B: (Participation at the international level)
i) Minimum two years of service in the Bank
ii) Should have represented India at least twice at the recognised international level in any of the games specified (which are furnished hereunder) and have actually participated (not merely being a reserve or standby) the last representation being not earlier than one year from the date of consideration for promotion.
"Recognised International Level" means the games recognised as an International Game by the Bank/Banks’ Sports Board.
GAMES SPECIFIED :
and such other games approved by the Bank/Banks’ Sports Board.
CATEGORY C: (Participation at National Level)
Minimum Five years service in the Bank should have represented the State at least thrice in any of the athletic / games / individual events recognised by the Indian Council of Sports / Indian Olympic Committee / State Sports Council and should have actually participated (not merely being a reserve or standby).
However, last representation should have been not earlier than two years from the date of consideration for promotion.
Representing State means participation in All India Inter-State matches at Senior level and it is specifically understood that participation in any event under invitation matches is not included in this category.
Representing the State at least thrice means representing thrice consecutively immediately preceding three years as on the date of application.
GAMES SPECIFIED :
and such other games approved by the Bank/Banks’ Sports Board.
III. MODE OF EFFECTING PROMOTIONS :
Employees shall be interviewed by a Three Member Committee, two of whom shall be Executives and third one belonging to SC/ST may also be an executive or in the alternative, not below the rank of Scale II. Marks for interview will be awarded independently by each member and average of marks awarded by the members will be taken to be the marks obtained by an employee for interview.
The marks for interview, qualification and service record shall be as under :
The candidates will be interviewed by the Committee to assess their banking knowledge and potential as under :
NOTE:
a) For being considered for promotion under Sports Category, an employee shall secure a minimum of 28 marks out of 70 allotted for Interview. In respect of employees belonging to SC/ST, they shall secure a minimum of 24.5 marks.
b) Marks for Confidential Reports and Service Record shall be as given in the settlement and awarded proportionately.
c) Thereafter, the candidates will be ranked on the basis of the marks secured in I to III above. The promotion will be done on the basis of such ranking.
VACANCIES :
Not more than 2% of the vacancies declared in the officers cadre (Junior Management Grade Scale I) in the previous year, subject to a maximum of 10 vacancies per application. There will be no carry over of backlog.
PROMOTION OF HIGHLY QUALIFIED EMPLOYEES FROM CLERICAL TO OFFICERS CADRE :
ELIGIBILITY :
Employees who possess the following technical / professional qualifications from any of the recognised Universities/Institutions shall be considered for promotion to the Officers' Cadre as given below :
1. ACA or ICWA 2. BE or AMIE 3. MBA (I Class/ 'A' Grade or a pass from any of the IIMs) 4. ACS 5. MCA
Employees possessing the above qualifications with 2 years of service as on 1st July are eligible for consideration for promotion.
Eligible employees satisfying qualification and service conditions shall be administered a common Written Test, in which they should secure a minimum of 40 Marks for general category employees and 35 marks for SC/ST employees for pass. They shall be administered Interview and awarded marks as prescribed below :
Employees who have come out successful in the Written Test shall be interviewed by a Three Member Committee, two of whom shall be Executives and third one belonging to SC/ST may also be an executive or in the alternative, not below the rank of Scale II. Marks for interview will be awarded independently by each member and average of marks awarded by the members will be taken to be the marks obtained by an employee for interview.
The marks for interview, qualification and service record shall be as under :
The candidates will be interviewed by the Committee to assess their banking knowledge and potential as under :
For awarding weightage for marks for written test, for every one mark secured, 0.50 marks weightage for promotion will be extended.
The candidates who have been interviewed will be ranked on the basis of marks secured in I to IV above.The promotion will be done on the basis of such ranking.
VACANCIES :
Maximum 20 per application on the same basis as assessed for sportsmen. There will be no carry over of backlog.
6). GENERAL CONDITIONS FOR ALL PROMOTIONS :
a) From the ranking list to the extent of promotion, provided for under each Tier viz., Merit Tier and Merit cum Seniority Tier, vacancies shall be filled in the same order. Ranking list of all eligible employees shall be maintained and the vacancies arising out of employees whoever promoted during the particular application but declining promotion shall be filled up. Ranking list shall be valid till the commencement of selection process for the next application.
b) It is agreed that consideration for promotion of those employees against whom any proceedings on charges of misconduct/offence are pending before a domestic enquiry or court of law shall be withheld till the final outcome. If such charges are proved, consideration of their cases for promotion to Junior Management Grade Scale I will be deferred for a period of two years from the date of awarding punishment. If the employee is exonerated and if he comes within the ranking, he will be considered for promotion from the date on which he would have otherwise been considered but for chargesheet. If the punishment of “Censure”, “Warning” or “Adverse Remark” is imposed, his promotion shall be released from the date of imposing the punishment, provided he comes within the ranking.
c) An employee promoted in terms of this settlement, shall be on probation for a period of one year, which may be extended further by a period not exceeding 12 months in multiples of 3 months.
d) Confirmation of an employee who has been promoted is subject to his/her successfully completing period of probation. There shall however be no test during that period of probation for purpose of confirmation.
e) Such of those probationers whose work and progress are not satisfactory during the period of probation are liable for reversion to their substantive post in the clerical cadre.
f) It is agreed that an employee aggrieved by non-promotion if he so desires, shall have the right to prefer an appeal in the matter to the General Manager, Personnel Wing of the Bank. Such appeal shall be preferred within 60 days from the date of publication of results Any appeal submitted beyond the stipulated period will not be considered. All appeals shall be disposed of within eight months from the date of publication of the results.
g) It is agreed that for application of the formula the relevant date shall be the date of declaration of vacancies, such declaration being made as on 1st July.
h) The percentage of reservation and relaxations given to SC/ST/PWD category of employees and weightage given to Ex-servicemen employees for their past service shall be as per Government directives/Guidelines issued from time to time.
i) Employees who have come out successful in the written test / have been interviewed but not promoted have to undergo the process of test / interview along with others in the subsequent applications.
THE ABOVE SETTLEMENT SHALL COME INTO FORCE FROM 01.07.2005 AND SHALL REMAIN IN FORCE FOR A PERIOD OF THREE YEARS. DATED AT BANGALORE, THIS, THE TWENTY SECOND DAY OF MARCH, TWO THOUSAND SIX.
